Welcome to Studio Lakas (“we”, “us”, “our”, “the company”, “the studio”.
These Terms and Conditions (“Terms”, “our Terms”) govern your use of our services, including reformer Pilates, available through our website (“www.studiolakas.com”, “the site”) and at our physical location (“THE PREMISES”).
By accessing or using our services, you (“the customer”) agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.
Sessions and Access
Upon signing the Registration and Health Waiver form, an individual will be granted membership to the studio, subject to adherence to these Terms and Conditions. The decision to accept a person as a customer rests solely with the Company.
Studio Lakas maintains the authority to revoke, suspend, or not renew the membership of any individual whose conduct is deemed detrimental to the studio’s ethos or violates these Terms and Conditions. This action may also be taken if it is considered to be in the best interest of other customers. Such conduct includes, but is not limited to, threatening behavior towards staff and customers, verbal and physical abuse, and causing disruptions during Reformer Pilates sessions. Expelled customers will lose all benefits associated with their session package or membership and are not entitled to any refund for the duration of their suspension.
Studio Lakas may occasionally offer promotional introductory deals (either directly or through third parties).
Studio Lakas holds the right to cancel any unlimited session package or membership in cases of its misuse, such as habitual non-attendance or booking sessions without the intention to participate. Affected customers will not receive a refund, will have their online booking privileges suspended, and any future booked sessions will be cancelled.
Bookings and Cancellations
Customer-Managed Bookings: All session bookings and cancellations must be managed online by customers through their own accounts.
Activation and Validity of Sessions/Packages: Single sessions and packages are activated as described at point of sale. Their validity period, indicated at purchase, must be monitored by customers to ensure it aligns with their session attendance plans.
Non-Extendable Sessions and Packages: Sessions and packages are strictly non-extendable and must be utilised within the stated validity period. No cash refunds.
Extension due to Injury/Illness: If injury or illness prevents usage within the validity period, any extension granted is entirely at management’s discretion and not guaranteed, even with medical evidence.
Limit on Extensions for Recurring Conditions: For recurring injuries or medical conditions, session package extensions are limited to one period. Customers should be aware of this when purchasing passes.
Restrictions on Introductory Offers: These offers are not available to those who have previously attended a session or are currently using a session pass. These are for new customers only.
Responsibility for Session Usage: The Company is not liable for incorrect usage of session packages leading to unused or expired sessions. Packages and sessions are non-transferable and specific to the purchasing customer.
Cancellation Policy: Customers must cancel a session at least 12 hours prior to the scheduled class start time to be entitled to a credit to rebook. Failure to cancel within the specified timeframe will result in forfeiture of the session and class credit. IF YOU ARE AN UNLIMITED PASS HOLDER, A PENALTY CHARGE WILL OCCUR.
Class No-Show Policy: No-shows for scheduled classes will forfeit the session and class credit. IF YOU ARE AN UNLIMITED PASS HOLDER, A PENALTY CHARGE WILL OCCUR.
Email Cancellation Requests: Cancellations via email may not be processed in time, and the standard cancellation policy will apply. Ensure to use the booking system to action any cancellation or reschedule requests.
Waiting List Policy: Customers must have valid credits or payment on their account to reserve waiting list spots. Reservations without credits/payment will be removed to prevent unpaid session reservations.
Late Arrivals: If you arrive 5 minutes or more after your scheduled class start time, your booking will automatically be cancelled. This is due to the missed warm-up and health and safety considerations.
First Time Customers: If you have never used the reformer before, you must arrive at least 5 minutes early so the instructor can provide a brief introduction to the equipment before the class begins. It is recommended for all customers to arrive 5 minutes early.
Locked Door Policy: The studio door will be locked after the warm-up to ensure a safe and uninterrupted session. Latecomers will not be permitted entry.
Payments
Session Prices and Session Packages: Up-to-date details about session prices and session packages can be found on our website at (www.studiolakas.com). These prices are subject to change as determined by the Company.
Use of Sessions: Payment for sessions at our studio grants access only to sessions conducted by this Company. This does not include sessions at other reformer Pilates studios not operated by us, even if such sessions are available.
Refund and Transfer Policy: Except as required by law, payments made for sessions, session packages, monthly subscriptions, and gift cards are non-refundable and non-transferable. Any exceptions to this policy will be explicitly stated in our Terms and Conditions.
All prices include VAT (if applicable).
Direct Debits/Standing Orders
Applicability: This section applies exclusively to customers who opt for a monthly membership via a monthly direct debit or standing order (referred to as “Subscription”).
Obligatory Subscription Fees: Subscription fees are due as outlined in the Terms and Conditions, regardless of actual facility usage.
Notice of Subscription Fee Increase: Customers will receive at least 30 days’ written notice before any increase in Subscription fees.
Minimum Subscription Period: Subscriptions cannot be cancelled within the initial 3 months from the first payment date (the “Minimum Subscription Period”).
Cancellation Post-Minimum Period: After the Minimum Subscription Period, customers may cancel their Subscription by submitting a written request to (info@studiolakas.com) 30-day notice from the desired cancellation date is required. Customers are liable for one month’s subscription fee during this notice period.
Non-transferable Membership: Membership is personal and non-transferable. Lending membership to others will result in termination without refund.
Liability for Unpaid Subscription: Customers are liable for the full amount of the Minimum Subscription Period if they fail to pay or cancel within this period. Merely cancelling the direct debit or standing order does not constitute cancellation of the contract.
Cancellation of Payment Instructions: Customers are responsible for cancelling their direct debit or standing order with their bank upon Subscription termination. The Company is not liable for payments made due to the customer’s failure to cancel these instructions.
Authorisation for Payment: By providing payment details, you authorise Studio Lakas to collect subscription fees and any overdue amounts by charging your nominated payment method, without further notice.
General Terms
Adherence to Studio Guidelines: Customers are required to follow the studio guidelines as communicated and comply with any reasonable instructions from management to facilitate efficient operation and convenience for all customers.
Notification of Contact Information Changes: Customers must inform the Company in writing of any changes in their home or email address. Without such notification, communications are deemed received within 5 days of mailing to the last known address.
Right of Admission: The Company reserves the right to refuse entry to the studio.
Non-Party Rights: Individuals not part of the Registration Form have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any Terms of the Registration Form.
Email Communications: Customers consenting to email communication accept the risks associated with this method. The Company is not liable for any loss or damage resulting from email communication.
Our Terms: Separate Terms may apply to private hire, corporate bookings, and special events, which will be agreed upon in writing. Studio Lakas shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from events beyond its reasonable control (including but not limited to acts of God, strikes, accidents, or government restrictions).
Privacy Policy: Our use of your personal information is governed by our Privacy Policy, available at (www.studiolakas.com). By using our services, you consent to such processing and warrant that all data provided by you is accurate.
Limitation of Liability
Service and Equipment Availability: The Company is not responsible for unavailable services or equipment. The Company may alter facilities at its discretion without notice and is not liable for any related loss, except as required by law.
Customer Responsibility, Health Waiver and Assumption of Risk: By attending our classes or using studio equipment, you confirm that you are in good health and physically capable of participating. You voluntarily assume all inherent risks of physical activity, including the risk of injury, illness, accident, or death. Studio Lakas Ltd, its instructors, and staff are not liable for any such outcomes, except where liability cannot legally be excluded under Scottish law. If you have, or develop, any medical condition, injury, or are taking medication that may affect your ability to exercise safely, you must consult with a doctor before participating. We may, at our discretion, request written medical clearance. It is your responsibility to inform the instructor of any relevant health conditions before each class.
Communication of Injury or illness: Customers are responsible for communicating any injuries or illnesses to instructors before the scheduled class starts. Instructors and Studio Lakas Ltd are not liable for the repercussions of participation, and customers are encouraged to listen to their bodies and take breaks when necessary.
Personal Property and Injury Liability: The Company is not liable for loss or damage to personal property or injury to customers or their guests on studio premises, except where such liability cannot be legally excluded.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by Scottish law.
Pregnancy Terms
Acknowledgement of Pregnancy Risks: Customers who are Pregnant or become Pregnant during their package or membership at Studio Lakas acknowledge that participating in physical activities, including but not limited to reformer Pilates, carries inherent risks. Pregnant customers must recognise that these risks may be heightened during pregnancy.
Pregnancy Medical Clearance: Prior to participating in any fitness program or continuing an existing program, pregnant customers must consult with their doctor and obtain written medical clearance. This clearance should specifically state that the customer is permitted to engage in physical activity during their pregnancy. Studio Lakas reserves the right to request updated medical clearance at any stage of the pregnancy. Failure to provide medical clearance when requested may result in suspension of membership without refund.
Pregnancy Modifications and Limitations: Pregnant customers are required to inform the instructor before each class about their pregnancy and any related medical conditions. Instructors will offer modifications to exercises as needed. However, it is the responsibility of the customer to assess their own physical condition and limitations and to avoid any activities that may pose a risk to their health or the health of their unborn child. Customers are encouraged to focus on gentle and moderate activities during their pregnancy.
Customers agree to notify Studio Lakas of any changes in their pregnancy status or any related health issues that may affect their ability to safely participate in fitness activities.
Personal Items
Customers bring personal items to the studio at their own risk. The Company is not responsible for the loss or damage of any such belongings.
Dress Code
Customers are advised to wear comfortable, suitable sportswear to classes. If wearing shorts, ensure they are not loose fitted.
Footwear: Shoes must be removed for all classes.
Socks: For safety and hygiene, grip socks are required to be worn. These are available to purchase at the studio or can be brought with you.
Water bottle: Bringing a water bottle to rehydrate during the class is advisable.
Safety and Hygiene
Entrance and Exit: Customers must use the designated entrance when entering or leaving the studio. Fire exits, clearly marked for your safety, should not be tampered with under any circumstances.
Fire Safety: In case of fire, customers are instructed to promptly proceed to the nearest exit.
Foot Hygiene: Customers with verrucae or similar foot conditions must avoid walking barefoot in the studio. It is advisable for all customers to avoid walking barefoot.
Pet Policy: Pets are not permitted in the studio or its grounds, with the exception of guide dogs.
Reformer Equipment Use: Each reformer has a designated training area equipped with necessary training equipment and cleaning materials.
Equipment Cleaning: Post-class, customers are expected to clean their reformer and any used training equipment with the provided cleaning materials, ensuring readiness for the next user.
Hand Sanitisation: Hand sanitiser is available at the front desk to use.
Medical Emergencies: In the event of a medical emergency, staff may provide basic first aid and will contact emergency services. By attending classes, you consent to this.
Notices: Customers must comply with all health and safety notices displayed in the studio.
Age Restrictions
The minimum age restriction to attend our sessions is 16 years old.
For participants aged 16-17, a parent or guardian must co-sign the waiver form prior to their first class.
Media Usage Policy
Promotional Activities: By signing our Health Waiver and entering the studio, you consent to Studio Lakas capturing and using photographs and videos for marketing and promotional purposes (including social media, website, and print), without additional compensation.
Addressing Concerns: If a customer has any concerns regarding media use, they should promptly bring these to the attention of the staff.
Customer Photography: Customers are permitted to take photos on the premises for social media purposes but must be considerate of others present in the studio. Please ensure no other customers are in view and there are no disruptions to the class. It is recommended to ask permission from those around you before filming.
Changes to These Terms
We reserve the right to update or modify these Terms at any time. Any changes will take effect immediately upon posting on our website. Continued use of our services after such changes constitutes your acceptance.
